Preamble to the Constitution of India - संविधान की प्रस्तावना

A preamble(संविधान की प्रस्तावना) is an introductory statement in a document that explains the document’s philosophy and objectives.

In a Constitution, it presents the intention of its framers, the history behind its creation, and the core values and principles of the nation.

The preamble basically gives idea of the following things/objects:

Source of the Constitution
Nature of Indian State
Statement of its objectives
Date of its adoption

History of the Preamble Of Indian Constitution

भारत के संविधान की प्रस्तावना के पीछे के आदर्श(ideals) जवाहरलाल नेहरू के उद्देश्य संकल्प (Objectives Resolution) द्वारा निर्धारित किए गए थे, जिसे 22 जनवरी, 1947 को संविधान सभा(Constituent Assembly) द्वारा अपनाया गया था।

Status of Preamble

Berubari Case :

बेरुबारी मामले के माध्यम से, न्यायालय ने कहा कि ‘प्रस्तावना निर्माताओं के दिमाग को खोलने की कुंजी है’ लेकिन इसे संविधान का हिस्सा नहीं माना जा सकता है। (‘Preamble is the key to open the mind of the makers’)

Kesavananda Bharati Case :

संविधान की प्रस्तावना को अब संविधान का हिस्सा माना जाएगा.

प्रस्तावना किसी प्रतिबंध या निषेध की सर्वोच्च शक्ति या स्रोत नहीं है, लेकिन यह संविधान के क़ानूनों और प्रावधानों की व्याख्या में महत्वपूर्ण भूमिका निभाती है।(The Preamble is not the supreme power or source of any restriction or prohibition but it plays an important role in the interpretation of statutes and provisions of the Constitution.)

Union Government Vs LIC of India : 1995

सुप्रीम कोर्ट ने एक बार फिर माना है कि प्रस्तावना संविधान का अभिन्न अंग(integral part) है लेकिन इसे Court में सीधे लागू नहीं किया जा सकता है।

42 वें संशोधन अधिनियम, 1976 के माध्यम से 3 शब्द , केवल एक बार संशोधन

हमारी प्रस्तावना में स्वतंत्रता, समानता और बंधुत्व की अवधारणा को फ्रांसीसी क्रांति के फ्रांसीसी आदर्श वाक्य से अपनाया गया था।
प्रस्तावना में 3 प्रकार के न्याय , 2 प्रकार की समानता तथा 5 प्रकार की स्वतंत्रता की बात की गयी है
